Delicious Entertaining Cookbook Competition, 2007

TERMS AND CONDITIONS

The competition and terms and conditions of the agreement below are in accordance with the Charitable and Non-Profit Gaming Act 1999 (Category 4) and is governed by the Queensland Office of Gaming Regulation.

1. Entry into the Competition is deemed acceptance of these terms and conditions. Entries not completed in accordance with these terms and conditions or received after the closing date will not be considered.

2. The Promoters are Australia Affair Pty Ltd and New Holland Publishers. The Promoters are not liable for lost, late or misdirected mail.

3. Only Queensland residents are eligible to enter. Employees of Australia Affair Pty Ltd (the “Promoter”) are ineligible to enter.

4. The Competition commences on 16 August 2007 at 0900 (AEDT) and closes on 21 September 2007 at 1700 (AEST). Entry to the Competition is via the Affair website – www.affairmagazine.com.au.

5. There are six major prizes to be given away. The draw will take place at 0900 (AEDT) on 24 September 2007 at Affair Magazine Head Office; Level 1, 132 Racecourse Road, Ascot, 4007, Queensland. The winners will be notified by mail, email or telephone on 24 September. The results will not be published. The judge’s decision is final and no correspondence will be entered into.

6. The prizes are strictly as stated above. The prizes are non-transferable, not exchangeable and non-redeemable for cash. Any additional charges including travel insurance, spending money, travel and other incidentals are the responsibility of the winners.

7. To enter, entrants must go to the Affair website (www.affairmagazine.com.au) and follow the link to the advertised competition. Once there, they must register his or her details, including the key number and complete all fields. Once this has been completed, users should click the submit button at the end of the entry form to lodge the entry.

8. The cost of accessing the promotional websites is dependant on the entrant’s ISP charges.

9. The winner must be able to provide proof of identity, proof of residency at the nominated address and proof of valid entry in order to claim the prize. The proof of identity, residency and entry necessary for verification will be at the discretion of the Promoter/s. If a winner cannot provide suitable proof, the winner will forfeit the prize in whole and no substitute will be offered.

10. The Promoter/s reserves the right to disqualify any entry, which in the opinion of the Promoter/s, includes invalid, objectionable or defamatory content. The Promoter may disqualify any entrant, who tampers with the entry process, who submits an entry that is not in the accordance with these terms or who has, in the opinion of the Promoter, engaged in conduct which is fraudulent, misleading, deceptive or damaging to the goodwill or reputation of the Promoter. This right continues after the announcement of the winner.

11. If an entrant’s contact details change during the competition period, it is the entrant’s responsibility to notify the Promoter (Affair Magazine Pty. Ltd.) in writing, at the address set out in these terms.

12. Prize details:

Winners will receive one of six copies of Delicious Entertainingby Peter Howard.

Total prize value: AUD$119.70 (each copy valued at AUD$19.95)

13. In the case of a prize being redeemed, the prize is to be taken between the 24 September 2007 to the 8 October 2007 subject to the availability of the Promoter/s (Australia Affair Pty. Ltd. and any other organisation involved in the promotion process) and/or the Promoter/s choosing and subject to conditions.

14. The prize cannot be transferred from the winner to another person or party for any reason and shall not be sold or placed on auction sites such as Ebay.

15. Where travel for a competition is concerned; any taxes, charges or fees imposed by the Australian government or by any foreign government or authority on arriving or departing passengers are payable by the winner and accompanying person at the time of ticket issuance.

16. To the full extent permitted by law, the Promoter/s exclude liability for any loss, damage or injury whatsoever suffered or sustained (including, but not limited to direct, indirect, special or consequential loss or damage, loss of opportunity revenue or profit) arising directly or indirectly out of or in connection with this promotion.

17. Where air travel in involved in a prize: airfares are strictly non-transferable. The cost of any meals and accommodation not specifically provided for, spending money, transfers to and from departure points, additional transfers, visas, passports, taxes, airport taxes and levies, travel insurance and all other ancillary costs associated with accepting the prize are the responsibility of the winner. A credit card imprint or cash deposit may be required from the winner at check-in to hotels for all incidental charges. Once accommodation vouchers are issued, they are not changeable.

18. The Promoter/s makes no representation as to the safety or conditions that may exist at any destination. International travel advice can be obtained from local consular offices and the website of the Australian Department of Foreign Affairs and Trade.

19. By entering this Competition, each entrant accepts full responsibility for the decision to participate in this Competition and take the prize should he/she be selected as winner. The winner releases the Promoter/s and each other organiser, their related bodies corporate, affiliates, officers, agents and employees (the “Released Parties”), from all liabilities, loss and damage of any kind arising at any time out of or in connection with the acceptance of, and participation in, the prize. Without limiting the foregoing, the Released Parties will not be liable for any personal injury, sickness or death, property loss or damage or other direct, indirect or consequential loss or damage of any kind, howsoever sustained or incurred, in connection with or arising out of the Competition or the prize, except for any liability which cannot be excluded by law.

20. Each entrant acknowledges that some activities forming part of a prize may be inherently dangerous. If you choose to participate, you do so at your own risk.

21. The Promoter accepts no responsibility for any variation in prize value. The Promoter/s reserves the right to substitute the prize for a prize of equal value or for the cash equivalent at its discretion.

22. The Promoter may conduct a further draw at the same place as the original draw on 9 October 2007 at 0900 (AEDT), in order to distribute a prize if the prize is unclaimed by that date. The winner will be notified by mail, email or telephone. The results will not be published.

23. The Promoter/s is not responsible for any omitted, incorrect or inaccurate information transmitted in relation to the Competition, including omissions or errors relating to equipment or programming, technical errors, interruptions, defects, delays in operation or transmission, communications line or telephone, mobile or satellite network failure, theft or destruction or unauthorised access to or alteration of entries.

24. The Promoter/s reserves the right in its sole discretion to disqualify any individual whom the Promoter/s has reason to believe has breached any of these terms or engaged in any unlawful or improper misconduct in relation to the Competition, including tampering with the entry process.

25. The promoter collects your personal information to assist us in providing the goods or services you have requested, to process your competition entries, and to improve our products and services. We or any of our Australian related companies may be in touch by any means (including email or SMS) to let you know about goods, services, or promotions, which may be of interest to you.
